This appears to be at least partially traced from the following AJVulpes piece: https://www.furaffinity.net/view/31288534/
Even in the fairly unlikely case that the tracing was done with the consent of the other parties involved in the original commission, credit should still be given to the original artist.

Considering that piece was 5 years ago and the request I made is to an artist who I saw make it live in a stream, it is fairly safe to say they are similar, but not traced. A trace is obvious as it'd be nearly identical, as for this? This was just the artist I comm'd working with the details I provided in terms of pose and expression.

Apologies, but it seems unlikely that this is not traced.
Elements of this ARE nearly identical. I highly recommend you compare them yourself in a program where you can manipulate images (Krita and Gimp are free and will work, the transform tools will be what you're looking for) and overlay the two. Put both images on different layers, reduce the opacity of one piece, then flip the AJVulpes piece, adjust its size, and rotate it a bit to the left. After you do, certain elements of the piece line up 1 for 1. The eyes, the shoulder and arm on the left, both hands, the ENTIRE sack and all of the bumps on it, and even the elbow sticking out on the right - all of them are identical, the lines match 1 for 1. It's not even that some parts were copied, adjusted, and moved around; the entire composition, top to bottom, lines up.
It's such a bizarre thing for the artist to do, considering that they're obviously talented, the piece has lots of original (as far as I know, at least) details on top of what has been traced. But, they're just that, details added on top, unfortunately.

It being an old piece actually makes it a bit more likely to be selected for tracing in my opinion, as they may have thought that it's old enough to not be recognized.
You having seen it drawn live is a bit tricky. It IS possible that the artist had an invisible layer on another window that only they could see and trace, while streaming only their art program. If there's any Vod of the stream, it would likely be helpful.

You're not at all in the fault for not realizing what was going on here - in fact, you're just as much of a victim as the artist being traced from, as you've been denied a properly original piece of artwork in exchange for your money.

It was a screen share, not a stream that has a vod. Either way, I got what I wanted in the end.
